Terms of Service
Terms governing your access to and use of JDPreferred.com
1 Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of JDPreferred.com and its related pages, features, tools, memberships, content, and services, collectively, the “Service.”
In these Terms, “JDPreferred,” “we,” “us,” and “our” refer to the operator of JDPreferred.com.
By accessing or using the Service, creating an account, purchasing a membership, submitting a job posting, or using an artificial-intelligence feature, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2 Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.
3 What JDPreferred Provides
JDPreferred is a job-listing and informational platform focused primarily on United States-based JD Preferred and JD Advantage opportunities. The Service may include aggregated job listings, employer-submitted listings, search and filtering tools, job alerts, bookmarks, career-related content, and artificial-intelligence tools.
JDPreferred is not an employer, recruiting agency, staffing agency, law firm, career-placement service, or agent of any employer or applicant. We do not accept job applications on behalf of employers, make hiring decisions, verify every employer or listing, or guarantee interviews, offers, placement, compensation, or career outcomes.
4 Accounts and Account Security
Certain features require an account. You agree to provide accurate information, keep your login credentials confidential, and promptly update information that changes.
You are responsible for activity occurring through your account unless caused by our own breach of duty.
Accounts and memberships are for the individual account holder and may not be shared, transferred, resold, or used to provide access to another person. You must promptly notify us through our contact form if you believe your account has been accessed without authorization.
5 Memberships, Trial, and Recurring Billing
Purchasing or starting a subscription establishes a membership and grants the individual account holder a limited, personal, nontransferable right to access the membership features available during the applicable trial or paid subscription period.
A subscription does not provide ownership of the Service, job listings, tools, software, data, or other content. Membership access may end when the subscription expires, is canceled, payment is not completed, or access is terminated under these Terms.
Your exact price and renewal interval will be displayed at checkout. The standard membership currently begins with a seven-day trial for $5. Unless canceled before the trial ends, the membership automatically renews at $29.99 per month until canceled.
By starting the trial or purchasing a subscription, you authorize us and our payment processor to charge the payment method you provide for the $5 trial and each recurring monthly charge, plus any applicable taxes.
You may cancel through your account settings. To avoid the next recurring charge, cancellation must be completed before the next billing date. After cancellation, access ordinarily continues through the end of the period already paid for.
Cancellation stops future renewals; it does not retroactively cancel charges already incurred.
Membership fees and trial charges are nonrefundable except where required by law or where we expressly agree otherwise. We do not provide prorated refunds for unused time, failure to use the Service, or cancellation after a renewal charge has been processed.
If we offer a subscription-pause feature, the terms displayed when you use that feature will govern the pause, including when billing and access resume.
We may change prices or payment terms prospectively by providing reasonable notice. A price change will not alter a billing period already paid for.
If a payment is declined, reversed, disputed, or otherwise not completed, we may suspend or terminate access and seek payment of amounts properly due. You remain responsible for maintaining a valid payment method.
6 Employer Job Postings
Employers and authorized representatives may submit jobs for review. Submission does not guarantee approval and does not create an obligation to pay.
We may approve, reject, request changes to, or decline any submission in our discretion based on fit, quality, legality, completeness, or the interests of the Service and its users.
The current price for an approved employer posting is $249 for a 30-day posting period. If a submission is approved, we send an invoice through Stripe or another payment provider. The listing is published after payment is received unless we agree otherwise in writing. The posting period begins when the listing is first published.
Approved paid listings may receive featured placement on the JDPreferred homepage and placement near the top of applicable member search results. Placement may vary based on site design, relevance, availability, and other operational factors.
We do not guarantee a fixed position, number of views, number or quality of applicants, interviews, hires, or any particular business result.
The employer or submitting party represents and warrants that:
- It is authorized to submit the listing.
- All submitted information is accurate and not misleading.
- The position is genuine and currently available.
- The application link is valid.
- The listing and hiring process comply with applicable employment, nondiscrimination, privacy, wage-transparency, advertising, and other laws.
Employers remain solely responsible for receiving applications, communicating with applicants, screening candidates, making hiring decisions, and complying with all laws applicable to the employment relationship.
JDPreferred is not a party to any communication, application, interview, offer, employment agreement, or dispute between an employer and an applicant.
We may format, shorten, categorize, tag, or make nonmaterial editorial changes to a submitted listing.
We may remove or suspend a listing if it becomes unavailable, contains inaccurate or unlawful content, creates risk, receives a credible complaint, violates these Terms, or no longer fits the Service.
Employer-posting fees are nonrefundable after publication, except as required by law or if we fail to publish the approved listing. Closing a position early, changing hiring needs, receiving fewer applicants than expected, or requesting removal before the end of the posting period does not create a right to a refund or extension.
7 Job Listings and Third-Party Content
The Service includes listings and other material obtained from employer websites, applicant-tracking systems, public sources, third parties, and employer submissions. Ownership of third-party content remains with its respective owner.
Job information may be incomplete, inaccurate, duplicated, changed, expired, or removed by the employer without notice to us.
Although we regularly update the Service and generally remove older listings, we do not guarantee that every listing remains open, that every link works, that all stated compensation or location information is accurate, or that we identify every potentially relevant job.
Our classification of a job as JD Preferred, JD Advantage, remote, salary-banded, featured, or otherwise categorized reflects our judgment or automated processes and may be imperfect.
Categories are provided for convenience and are not representations by the employer unless the employer expressly states them.
You are responsible for independently verifying the employer, position, application instructions, compensation, location, licensing requirements, and other material facts before applying or providing personal information.
Be alert to scams and never send money or sensitive financial information to a purported employer without independently verifying the request.
8 Artificial-Intelligence Features
The Service may use artificial-intelligence systems to create job summaries, analyze resumes, identify career paths, review resumes, compare a resume with a job description, rank or match jobs, or provide other informational output.
Certain user-initiated tools send submitted content to Google’s Gemini API or another disclosed third-party provider for processing.
Before using an AI tool, review the disclosure displayed with that tool. Do not submit confidential, privileged, proprietary, highly sensitive, or unnecessary personal information.
You grant us and the applicable provider a limited right to process the content you submit solely to operate the requested feature, maintain security, and comply with law, as further described in our Privacy Policy and the on-screen disclosure.
AI output is generated automatically and may be inaccurate, incomplete, biased, outdated, inconsistent, or unsuitable for your circumstances. Scores, matches, classifications, summaries, suggested job titles, resume comments, and career-path recommendations are estimates and opinions, not verified facts or promises.
AI features are provided for general informational purposes only. They are not legal, employment, recruiting, financial, educational, psychological, or other professional advice, and they do not create an attorney-client, recruiter-candidate, fiduciary, or advisory relationship.
You are responsible for reviewing output, verifying important information, and deciding whether and how to use it.
We do not guarantee that an employer, applicant-tracking system, recruiter, or hiring manager will agree with an AI analysis or that following an AI recommendation will improve an application or employment outcome.
9 Acceptable Use
You may use the Service only for lawful personal job-search, career-information, or authorized employer-posting purposes.
Unless we provide prior written permission, you may not:
- Scrape, crawl, harvest, download in bulk, copy, mirror, republish, aggregate, license, sell, or commercially exploit listings, data, or other Service content.
- Use bots, scripts, automated agents, browser automation, or other means to access the Service or extract data, except ordinary search-engine indexing authorized by us.
- Bypass or attempt to bypass a paywall, membership restriction, rate limit, access control, security measure, or technical protection.
- Share login credentials or use another person’s account.
- Reverse engineer, probe, test, interfere with, overload, disrupt, or introduce malicious code into the Service.
- Use Service content to build, train, improve, validate, or operate a competing database, job board, artificial-intelligence system, or commercial product.
- Submit false, misleading, discriminatory, unlawful, infringing, defamatory, fraudulent, or malicious content.
- Impersonate another person or falsely claim authorization to act for an employer.
- Use the Service in a way that violates applicable law or another person’s rights.
10 Content You Submit
You retain ownership of content you submit, subject to the limited rights granted in these Terms.
You represent that you have the rights and permissions necessary to submit that content and that our authorized use of it will not violate any law, contract, confidentiality obligation, intellectual-property right, privacy right, or other right.
For employer listings and other content intended for publication, you grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, format, edit, categorize, display, distribute, and promote the content for purposes of operating and marketing the Service during the posting period and for reasonable archival, security, recordkeeping, and legal purposes.
For resumes, job descriptions, and other content submitted to an AI tool, the more limited processing terms in Section 8, our Privacy Policy, and the disclosure shown with the tool apply.
11 JDPreferred Intellectual Property
The Service, including its design, software, selection and arrangement of content, original text, branding, logos, databases, search methods, classification criteria, prompts, workflows, and other proprietary materials, is owned by or licensed to JDPreferred and is protected by intellectual-property and other laws.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Service for its intended purpose. No other rights are granted.
You may not use the JDPreferred name, logo, or branding without prior written permission.
12 Third-Party Services and Links
The Service may link to employer websites, applicant-tracking systems, payment processors, analytics providers, email providers, artificial-intelligence providers, and other third-party services.
We do not control and are not responsible for their content, availability, security, privacy practices, terms, products, or actions.
Your use of a third-party service is governed by that third party’s terms and privacy policy. A link or integration does not constitute our endorsement or guarantee.
13 Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. The Privacy Policy is incorporated into these Terms by reference.
If there is a conflict concerning personal-information practices, the Privacy Policy controls.
14 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” JDPREFERRED DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS; THAT LISTINGS OR AI OUTPUT WILL BE ACCURATE OR CURRENT; THAT ANY JOB WILL REMAIN AVAILABLE; OR THAT USE OF THE SERVICE WILL RESULT IN AN INTERVIEW, OFFER, HIRE, PROMOTION, CAREER CHANGE, OR OTHER OUTCOME.
Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
15 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JDPREFERRED AND ITS OWNERS, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR EMPLOYMENT; OR DAMAGES ARISING FROM A THIRD PARTY, JOB LISTING, APPLICATION, EMPLOYER, APPLICANT, AI OUTPUT, SECURITY EVENT, OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO JDPREFERRED DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.
The limitations in this section apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or other liability that applicable law prohibits us from limiting.
16 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless JDPreferred and its owners, affiliates, contractors, service providers, and representatives from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising out of or related to:
- Your submitted content.
- Your employer listing.
- Your hiring or application conduct.
- Your violation of these Terms or applicable law.
- Your infringement of another person’s rights.
17 Suspension and Termination
We may suspend, restrict, or terminate your account or access, remove content, or refuse service if we reasonably believe you violated these Terms, created legal or security risk, misused the Service, failed to pay amounts due, or harmed users or the Service.
We may act without advance notice when immediate action is reasonably necessary.
You may stop using the Service at any time. Ending an account does not automatically reverse prior charges.
Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property protections, disclaimers, limitations of liability, indemnification, and dispute provisions.
18 Changes to the Service or These Terms
We may add, remove, suspend, or modify features, listings, content, prices, and other aspects of the Service.
We may also update these Terms. When changes are material, we will provide notice through the Service, by email, or by another reasonable method and will update the effective date.
Changes apply prospectively unless a different date is stated or applicable law requires otherwise.
Your continued use after updated Terms take effect constitutes acceptance. If you do not agree, you must stop using the Service and cancel any recurring membership before the next billing date.
19 Electronic Communications
You consent to receive agreements, notices, receipts, and other communications electronically, including through the Service and by email.
You agree that electronic communications satisfy legal requirements that such communications be in writing.
Marketing communications may be unsubscribed from as described in the message, but we may still send transactional or account-related communications.
20 Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Unless applicable law requires otherwise, the state and federal courts located in Harris County, Texas will have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts.
Before filing a claim, each party agrees to make a good-faith effort to resolve the dispute informally by providing written notice and allowing at least 30 days for a response.
21 Miscellaneous
These Terms and the Privacy Policy constitute the entire agreement between you and JDPreferred regarding the Service, except for additional written terms that expressly apply to a specific transaction or feature.
If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver.
You may not assign your rights or obligations without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of the Service.
Headings are for convenience only.
